Terms of Use

1. Ownership and Intellectual Property

The Human Authorship Evidence Standard (HAES), including the three-prong doctrine, the five element methodology, the compliance confidence framework, the gap analysis and framework mapping, and all associated written works, are the proprietary intellectual property of ZNS Solutions LLC and Steven Zapolski. These materials are protected by copyright, with a publication date of May 29, 2026, and are the subject of a provisional patent application filed with the United States Patent and Trademark Office on May 29, 2026 (ZNS-2026-001).

The HAES Evidence Engine software, including its code, design, user interface, field structure, PDF generation logic, AI analysis prompts, and all associated creative and technical elements, are the proprietary property of ZNS Solutions LLC.

Unauthorized reproduction, modification, distribution, resale, or commercial use of the HAES framework, methodology, software, or associated materials is prohibited without prior written consent from ZNS Solutions LLC.

2. License to Use

ZNS Solutions grants you a limited, non-exclusive, non-transferable license to use the HAES Evidence Engine for your personal and professional documentation purposes. This license does not include the right to:

• Reproduce or redistribute the HAES framework, methodology, or software
• Build competing products based on the HAES standard without a licensing agreement
• Remove or alter ZNS Solutions branding, copyright notices, or attribution
• Use the HAES name, brand, or certification marks without written authorization
• Sublicense access to the tool to third parties without a commercial agreement

3. Your Evidence Packages

The evidence packages you generate using HAES Evidence Engine belong entirely to you. ZNS Solutions does not claim any ownership over the content of your evidence packages. The tool processes your session data locally in your browser. No session content, conversation data, or evidence package content is transmitted to or stored on ZNS Solutions servers.

Your evidence packages are delivered directly to your device as PDF downloads. You are responsible for storing, protecting, and maintaining your evidence records. ZNS Solutions is not responsible for loss of evidence records due to browser storage limitations, device changes, or user action.

4. API Key and Data Privacy

The AI auto-population feature uses your Anthropic API key to send session content directly to Anthropic's API for analysis. Your API key and session content are transmitted directly from your browser to Anthropic. ZNS Solutions does not receive, store, or have access to your API key or the session content you submit for analysis.

You are responsible for your own Anthropic API usage, costs, and compliance with Anthropic's terms of service. ZNS Solutions is not responsible for any charges, data handling, or privacy implications arising from your use of the Anthropic API.

5. Not Legal Advice

HAES Evidence Engine and the Human Authorship Evidence Standard reflect governance and compliance best practices developed from a GRC professional perspective. Nothing in this tool, the HAES whitepaper, the gap analysis, or any ZNS Solutions materials constitutes legal advice. The evidence packages generated by this tool are governance documentation tools, not legal instruments.

Organizations and individuals with specific questions about copyright protection, intellectual property ownership, employment law, or regulatory compliance should consult qualified legal counsel in their jurisdiction.

6. No Warranty

HAES Evidence Engine is provided as-is without warranty of any kind. ZNS Solutions does not warrant that the tool will meet your specific legal or compliance requirements, that evidence packages generated will be accepted by any particular court, examiner, or regulatory body, or that the tool will be available without interruption.

7. Limitation of Liability

To the maximum extent permitted by applicable law, ZNS Solutions LLC and Steven Zapolski shall not be liable for any indirect, incidental, special, consequential, or punitive damages arising from your use of HAES Evidence Engine, including but not limited to loss of data, loss of intellectual property rights, or adverse outcomes in legal or regulatory proceedings.

8. Licensing Inquiries

Organizations interested in licensing the HAES standard for platform integration, enterprise implementation, or product development should contact ZNS Solutions directly. Licensing inquiries, partnership discussions, and enterprise consulting engagements are welcome.

11. HAES Compliance Certification

The Human Authorship Evidence Standard is a proprietary governance doctrine owned by ZNS Solutions LLC. The designations HAES-Compliant, HAES Certified, HAES Evidence Package, and HAES Standard are certification marks of ZNS Solutions LLC, with common law trademark rights established by first use in commerce on May 29, 2026, and federal trademark applications pending with the United States Patent and Trademark Office.

Only software, tools, platforms, and implementations that have received explicit written authorization from ZNS Solutions LLC may represent themselves as HAES-compliant, HAES-certified, capable of producing HAES-standard evidence packages, or implementing the Human Authorship Evidence Standard. HAES Evidence Engine is the only currently authorized implementation of the HAES standard.

Unauthorized use of HAES compliance designations, certification marks, or any representation that a product or service implements, complies with, or is certified under the Human Authorship Evidence Standard constitutes trademark infringement and unfair competition and will be pursued accordingly.

Organizations and platforms seeking authorization to implement the HAES standard should contact ZNS Solutions LLC to discuss licensing terms.

12. Trademark Notice

The following are trademarks and certification marks of ZNS Solutions LLC, with common law rights established by first use on May 29, 2026, and federal registration applications pending:

Unauthorized use of these marks in connection with any product, service, or publication is prohibited without prior written consent from ZNS Solutions LLC.

ZNS Solutions reserves the right to update these terms at any time. Continued use of the tool following any update constitutes acceptance of the revised terms. The current effective date is displayed at the top of this page.
